G.S.R.559(E).--In exercise of the powers conferred by clause (e) of sub-section (2) of section 63 of the Water (Prevention and Control of Pollution) Act, 1974, (6 of 1974), the Central Government, in consultation with the Central Pollution Control Board, hereby makes the following rules regulating the terms and conditions of service and recruitment to the post of the Member-Secretary to the Central Pollution Control Board, namely:--

1. Short title and commencement.--(1) These rules may be called the Central Pollution Control Board (Member-Secretary, Terms and Conditions of Service and Recruitment) Rules, 2008.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and scale of pay.--The number of the said posts, its classification and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc.--Method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (14) of the said Schedule.

4. Conditions of service.--The conditions of service of the Member-Secretary to the Central Pollution Control Board in the matters of pay, allowances, leave, provident fund, age of superannuation, retirement benefits, medical facilities and other conditions of service, shall be regulated in accordance with such rules and regulations as are for the time being applicable to officers and employees of the Central Government belonging to Group A of the corresponding scales of pay stationed at those places.

5. Disqualification.--No Person,--

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under personal law applicable to such person or the other party to the marriage and there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax.--Where the Central Government is of the opinion that it is necessary or expedient to do so, it may by order for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.--Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for Schedule Caste, Schedule Tribe, Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

By deputation including short-term contract

Deputation:

Officers of the Central or State Government or public sector undertaking or University or Government research institution or autonomous or statutory body--

 

(a)(i) holding analogous posts on regular basis in the parent cadre or department; or

 

(ii) with four years of regular service in the grade rendered after appointment thereto on regular basis in the scale of pay of Rs.14300-18300 or equivalent in the parent cadre or department, and (b) possessing the following qualification and experience:

 

(i) Master's degree in Physical Science relating to environment or Degree in Engineering in a discipline relating to environment from a recognized institute or university or equivalent; and

 

(ii) Sixteen years experience in government department/institution or central public sector Undertaking or University/government research institution or autonomous or statutory body at the administrative or managerial level with practical experience in matter relating to scientific,

 

engineering or management aspects of pollution control.

 

Desirable: Ph.D in Physical Science relating to Environment or M.Tech in Engineering in a discipline relating to Environment from a recognized institute or University or equivalent.

 

Note 1.--Period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization or department or the Central Government shall ordinarily not exceed three years.

 

Note 2.--The maximum age limit of appointment by deputation shall be not exceeding fifty four years as on the closing date of the receipt of applications.
