Environment – Coastal Regulation Zone – Environment (Protection) Act, 1986 – appeal objecting construction of hotel on plot of land on ground that land comes within Coastal Regulation Zone 1 (CRZ 1) – area of proposed construction designated as settlement area and categorised as CRZ 3 – several earlier settlements and constructions exists over area – Department of Environment and Forest taken adequate care before giving clearance – appellant failed to establish by referring to authentic material any infraction of CRZ Notification – appeal dismissed.



JUDGMENT

1. Leave granted. Expedited.

2. Liberty to move for a fixed date of hearing.

3. Pending the disposal of the appeal, the status quo as of today shall be maintained, subject to the first respondent making such construction as is necessary to safeguard what has already been built.
