Directions under Section 5 of Environment (Protection) Act, 1986 regarding identification of violations under the Coastal Regulation Zone Notification, 1991 and initiation of action thereon

Whereas, the Ministry of Environment and Forests (MoEF) had issued a Direction under Section 5 of Environment (Protection) Act, 1986 vide letter of even number dated 25 January, 2011 to Chairman, State/Union Territory (UT) Coastal Zone Management Authorities Chief Secretaries of coastal States/UT, Secretary/Principal Secretary, State/UT Environment Department and Regional Offices of MoEF to,-

a). identify the violations of the Coastal Regulation Zone (CRZ) Notification, 1991 and the approved Coastal Zone Management Plan thereunder within their respective jurisdiction in a period of four months from the receipt of this directions;

b). initiate action under the Environment (Protection) Act, 1986 upon the identified violations within four months thereafter;

c). upload the relevant details of the identified violations, including the action taken on the violations, as per paras (a) and (b) above on their respective website, every fortnight.

2. Whereas, the above Authorities and Agencies were directed to identify the violations of CRZ Notification, 1991 within four months from 25th January, 2011.

3. Whereas, the coastal State/UT Governments have been repeatedly requesting the MoEF and the National Coastal Zone Management Authority to extend the time period for identifying the violations due to various logistical problems and shortage of manpower.

4. Now, whereas, the Ministry taking into consideration the above reasons provided by the coastal State/UT Government have decided to extend the time period for identifying the violation of CRZ Notification, 1991 upto 30th October, 2011.
